Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and the developer identified for Cheekful in the Apple App Store listing (“Cheekful,” “we,” “us,” or “our”). They govern your access to the Cheekful mobile application, share extension, AI and import features, and cheekful.food (collectively, the “Service”). By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy.

Your license to the iOS application is also governed by Apple’s Standard Licensed Application End User License Agreement, unless a different EULA is presented in Cheekful’s App Store listing. The applicable App Store EULA controls if it conflicts with these Terms on licensing of the application.

2. Eligibility and accounts

You must be at least 13 years old, or the higher minimum age required in your country, to use Cheekful. If you are not old enough to enter a binding contract, a parent or legal guardian must review and accept these Terms for you. The Service is not intended for children below the applicable minimum age.

Cheekful may begin with an anonymous account. You may later link an Apple or Google identity. You are responsible for access to your device and account and for keeping linked account credentials secure. Notify us through App Support if you suspect unauthorized use.

3. The Service

Cheekful helps you import, organize, edit, translate, plan, share, and cook recipes. Some features use third-party services and artificial intelligence. We may improve, modify, suspend, or discontinue features, subject to applicable law and any rights attached to an active paid subscription.

You receive a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for lawful, non-commercial purposes. No ownership in Cheekful software, branding, or service content is transferred to you.

4. Your content and imported material

You retain ownership of recipes, notes, photos, messages, and other material you submit (“User Content”). You grant us a limited, worldwide, royalty-free license to host, process, reproduce, adapt, transmit, and display User Content solely to operate, secure, and provide the features you request. This license ends when the content is deleted, subject to limited backups, legal retention, and content you intentionally shared with others.

You represent that you have the rights and permissions needed to submit and process User Content and source links. You are responsible for respecting copyright, privacy, platform terms, and other third-party rights. Cheekful does not authorize bypassing access controls or importing material you are not legally permitted to use.

5. AI and recipe safety

AI-generated recipes, translations, nutrition estimates, ingredient substitutions, image interpretations, and allergen indicators may be incomplete or incorrect. They are suggestions, not medical, dietary, nutritional, or professional advice. You must review ingredients, quantities, cooking temperatures, storage guidance, allergens, and dietary suitability before relying on any output.

Never rely on Cheekful as the sole source for allergy safety, foodborne illness prevention, medical nutrition, or treatment decisions. Follow product labels and official food-safety guidance and consult a qualified professional where appropriate. AI suggestions change a saved recipe only when you use the explicit apply or save control.

6. Cheekful Pro subscriptions

• Cheekful may offer monthly or yearly auto-renewing subscriptions, free trials, or introductory offers. The purchase screen shows the current price, billing period, and included features before confirmation.
• Payment is charged to your Apple ID account when you confirm the purchase. A subscription renews automatically unless canceled at least 24 hours before the end of the current billing period.
• Your Apple ID account is charged for renewal within 24 hours before the current period ends. You can manage or cancel the subscription in your Apple account subscription settings.
• Any unused portion of a free trial may be forfeited when a subscription is purchased where permitted by Apple. Deleting Cheekful or deleting your Cheekful account does not automatically cancel an Apple subscription.
• Billing, cancellation, restoration, and refund decisions are administered through Apple and are subject to Apple’s applicable terms and refund policies. Mandatory consumer rights remain unaffected.

7. Acceptable use

You may not:

• use the Service unlawfully, fraudulently, or to violate another person’s rights;
• submit malicious code, illegal content, credentials, or highly sensitive information not needed for a recipe feature;
• probe, bypass, disable, or interfere with authentication, quotas, access controls, security, or Service infrastructure;
• scrape, reverse engineer, resell, sublicense, or commercially exploit the Service except where applicable law expressly permits;
• use automated means that create unreasonable load or attempt to access another user’s account or private content;
• misrepresent AI output as professionally verified or use the Service in a way likely to cause harm.

8. Third-party services and links

The Service relies on providers such as Apple, Google, Supabase, OpenAI, Apify, Google Cloud Translation, Pexels, RevenueCat, and Cloudflare. Their services and external links may be governed by their own terms and privacy policies. We are not responsible for third-party services outside our control, although we remain responsible for our own obligations under applicable law.

9. Suspension, termination, and deletion

You may stop using Cheekful at any time and may delete your account in the Account screen. We may restrict or terminate access if reasonably necessary to protect users or the Service, comply with law, address fraud or security threats, or respond to a material breach of these Terms. Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.

Provisions concerning ownership, payments already due, disclaimers, limitations, and dispute handling survive termination to the extent necessary to give them effect.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant uninterrupted availability, error-free imports, permanent storage, or the accuracy, completeness, safety, or fitness of recipes, nutrition values, translations, AI output, or third-party content. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Cheekful and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, profits, goodwill, or business interruption arising from the Service. For claims that may lawfully be limited, total liability will not exceed the greater of the amount you paid for Cheekful during the 12 months before the claim or USD 50. These limits do not apply where prohibited, including liability that cannot be excluded for fraud, willful misconduct, death, personal injury, or mandatory consumer protections.

12. Law and disputes

Applicable law governs these Terms without removing mandatory consumer protections available in your country of residence. Before starting a formal claim, you and Cheekful agree to make a reasonable effort to resolve the matter through the App Support contact, unless local law gives you the right to proceed directly before a court, regulator, or alternative dispute body.

13. Apple-specific terms

Apple is not responsible for maintaining or supporting Cheekful. To the extent required by the applicable App Store EULA, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the relevant license terms after your acceptance. Nothing here changes Apple’s obligations, if any, under its own terms or applicable law.

14. Changes and contact

We may update these Terms to reflect Service, legal, or security changes. We will update the effective date and provide additional notice when required. Changes do not retroactively reduce rights that cannot lawfully be reduced.
